How Quickly Can I Get A Divorce?

In Virginia, unless there are "fault grounds," parties must physically separate and wait six (6) months if they have no minor children, or one (1) year if there are minor children of the marriage.  There are steps that must be taken before the commencement and the expiration of this waiting period to secure your legal rights.  Please contact us to discuss your situation.

I've Been Charged With A Misdemeanor, What's The Worst That Can Happen?

The punishment for conviction of a misdemeanor in Virginia depends upon what "Class" of misdemeanor you have been charged with.  A Class 4 misdemeanor is the lowest misdemeanor charge, and it carries a fine of not more than $250.00.  A Class 1 misdemeanor is the highest misdemeanor charge, and it carries a fine of not more than $2,500.00 and confinement in jail for not more than 12 months, either or both.  The punishment you may receive, if found guilty, will depend upon many factors, such as prior criminal history, driving history etc.

I Have A Small Business. Can I Place You On Retainer For Any Incidents That Occur?

Yes.  Our office is small business friendly, and we will be happy to provide you with competent legal representation whenever, and if ever, the need arises.  We can represent your interests in employee relations issues, unemployment hearings, designing corporate policies and procedures to protect your rights, general legal compliance issues, incorporation issues, and more.  Please contact our office to arrange a personal meeting at your business (we like to get a "feel" of the office), and we can structure a plan that best suits your business's needs.

My Tenant Isn't Paying Rent.  How Quickly Can I Evict Him/Her?

There are several steps that must be taken prior to filing suit for eviction.  In Virginia, a suit for eviction is called a Summons For Unlawful Detainer.  Typically, a legal eviction will take anywhere between 2-3 months.  Contact us as soon as possible to ensure that your legal rights as a landlord are protected.

My Landlord Won't Respond To An Issue I Have With The Home.  What Should I Do?

Landlords in Virginia have certain obligations with respect to the property and your tenancy.  If you have made a request to the landlord to fix a particular issue and have gotten no response, please contact our office as soon as possible so we can protect your rights as a tenant.  Some tenants are under the impression that they can just stop paying rent.  While there is a grain of truth to this statement, there is a complicated legal procedure involved. There are many steps that must be taken before any payment is stopped, or you may face eviction for non-payment of rent.
